Herb Ellis Featured on Fox’s LiveNOW to Discuss Harvey Weinstein Retrial

Herbert I. Ellis, Esq. was recently featured on Fox’s LiveNOW, providing legal commentary on the New York retrial of former Hollywood producer Harvey Weinstein.
Weinstein is being retried after his 2020 conviction for sexual assault and rape was overturned. The New York Court of Appeals ruled that the original trial judge made procedural errors, including allowing testimony from additional accusers whose allegations were not part of the formal charges. The retrial focuses on the same core allegations that led to Weinstein’s initial conviction, but now faces stricter limits on what evidence can be presented.
During the original trial, prosecutors argued that Weinstein used his position as a Hollywood producer to exploit and assault women. The allegations against him helped spark the global #MeToo movement, encouraging survivors to come forward with their own experiences of sexual harassment, assault, and misconduct across the entertainment industry and beyond.
During his appearance, Herb discussed the legal strategies the prosecution and defense will likely employ, noting that both sides can build upon evidence and testimony from the first trial. However, he emphasized that the prosecution may face greater challenges in securing a conviction this time, particularly given the tighter restrictions on admissible evidence imposed by the appeals court.
